Invoices

• Payment term: no later than 30 days from the invoice date.
• If no written complaint is submitted within 5 days after the invoice date with a detailed description of the objection, the invoice is accepted as is.
• In the event of a dispute, only the courts of the judicial district of Antwerp have jurisdiction.
• In the event of non-payment on the due date, default interest of 12% on the invoice amount and a fixed compensation of 10% on the invoice amount with a minimum of €250 are due by operation of law and without notice of default.

Images & Archives

All images are kept on a server as a backup for 6 months from the day of the shoot. After that, you are responsible for archiving the files.

Copyright & Use

The intellectual property rights and copyrights on all supplied images remain the property of Niko Caignie & WorkHardPlayHard BV, unless otherwise agreed in writing.

The use of the images is limited to the purpose for which they were purchased or agreed. Any other use (such as commercial exploitation) requires prior written permission and may be subject to additional costs.

Niko Caignie & WorkHardPlayHard BV reserves the right to use images for its own promotional purposes (such as portfolio, website or social media), unless the client objects to this in writing before the start of the project.

Cancellation & Changes

In case of cancellation of an assignment less than 3 days before the planned date, a cancellation fee of 10% of the total quoted price will be charged, with a minimum of €500.

Changes to the assignment (such as timing or content) must be communicated in writing and may lead to a revision of the price or planning.

Force Majeure

In the event of force majeure (such as illness, technical failures, pandemics, natural disasters, etc.), WorkHardPlayHard BV reserves the right to postpone or cancel the order without any liability.

Algemene Voorwaarden

Facturen

• Betaaltermijn: uiterlijk 30 dagen factuurdatum.
• Indien er binnen de 5 dagen na factuurdatum geen schriftelijke klacht wordt ingediend met gedetailleerde omschrijving van het bezwaar, is de factuur aanvaard zoals ze is.
• Bij geschil zijn enkel de rechtbanken van het gerechtelijk arrondissement Antwerpen bevoegd.
• Bij niet-betaling op de vervaldag is van rechtswege en zonder ingebrekestelling een nalatigheidsintrest verschuldigd van 12% op het factuurbedrag en een forfaitaire schadevergoeding van 10% op het factuurbedrag met een minimum van €250.

Beelden & Archief

Alle beelden worden, vanaf de shootdag, 6 maanden bijgehouden op een server als backup. Daarna bent u zelf verantwoordelijk voor het archiveren van de files.

Auteursrecht & Gebruik

De intellectuele eigendomsrechten en auteursrechten op alle geleverde beelden blijven eigendom van Niko Caignie & WorkHardPlayHard BV, tenzij schriftelijk anders overeengekomen.

Het gebruik van de beelden is beperkt tot het doel waarvoor ze werden aangekocht of overeengekomen. Elk ander gebruik (zoals commerciële exploitatie) vereist voorafgaande schriftelijke toestemming en kan onderworpen zijn aan bijkomende kosten.

Niko Caignie & WorkHardPlayHard BV behoudt zich het recht om beelden te gebruiken voor eigen promotionele doeleinden (zoals portfolio, website of sociale media), tenzij de klant hier schriftelijk bezwaar tegen maakt vóór aanvang van het project.

Annulatie & Wijzigingen

Bij annulatie van een opdracht minder dan 3 dagen vóór de geplande datum, wordt een annulatievergoeding aangerekend van 10% van de totale offerteprijs, met een minimum van €500.

Wijzigingen aan de opdracht (zoals timing of inhoud) dienen schriftelijk te worden meegedeeld en kunnen aanleiding geven tot een herziening van de prijs of planning.

Overmacht

In geval van overmacht (zoals ziekte, technische storingen, pandemieën, natuurrampen enz.) behoudt WorkHardPlayHard BV zich het recht voor om de opdracht uit te stellen of te annuleren zonder enige aansprakelijkheid.
